By accessing or using the Philadelphia Corporation for Aging (PCA) websites, www.pcacares.org, www.keepseniorswarm.org, www.phillypetsandseniors.org, www.genphilly.org, www.stopseniorscams.org, and all other websites and communication channels of PCA with authorized links to this policy (collectively, the “Sites”), you agree to be bound by the following notice governing use of the Sites, as well as PCA’s Privacy Policy.  If you do not agree, you should not use or access the Sites.

General Content Disclaimer

PCA cannot and does not guarantee or make any warranty, express or implied, regarding the accuracy, reliability, or completeness of information included in the Sites, nor does PCA accept any responsibility for any loss, damage, or expense resulting from or related to use of this information.  The Sites are not intended to render professional or medical advice.  Information included in the Sites is subject to change without notice.

Rules for User-Generated Content

PCA reserves the right to refuse to post or to edit or remove, in whole or in part, any submissions you make to the Sites (i.e. user-generated content including but not limited to comments, forum messages, and photographs) (the “Submissions”) that is, in PCA’s sole discretion, abusive, defamatory, obscene, or otherwise unacceptable or undesirable.  PCA has the right but in no way the obligation to exercise such reservation of rights.

Comments must reflect the subject under discussion.  You shall not upload to, or distribute or otherwise publish on to the Sites any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material.  You further agree that you will not threaten or verbally abuse others, use defamatory or discriminatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages or “spam.”  The Sites shall be used only in a noncommercial manner.  You shall not, without the express approval of PCA, distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods or services.

By submitting information to the Sites, you grant PCA a perpetual, nonexclusive, worldwide, royalty free, sub-licensable license to the Submissions, which includes without limitation the right for PCA or any third party PCA designates, to use, transmit, copy, cache, tag, encode, modify, adapt and display such information in any and all media now know or hereinafter devised and represent that you have all necessary rights in such Submissions.

Third-Party Information and Websites

Information relating to third parties unrelated to PCA, including advertisements by third parties and links to websites operated by third parties (Third-Party Websites), is provided solely for informational purposes, and does not constitute an endorsement by PCA of the accuracy or reliability of any information, products and/or services provided by such third parties, nor does it signify any affiliation between the advertiser or Website owner and PCA.  Further, PCA assumes no responsibility for products supplied by or services rendered by, or arrangements made with, any third party. 

You assume complete responsibility and risk in your reliance on information contained in any advertisement or any Third-Party Websites.  Such advertisements and Third-Party Websites may offer services, products, or other resources and are provided for your convenience only.  Links to Third-Party Websites will take you to websites that are not related to PCA and not under our control.  Your use of such Third-Party Websites will be governed by each Website’s terms and conditions and other applicable policies.  PCA cannot be responsible or liable for any content or related materials contained on any such Websites.  You should be aware that the material posted on such Third-Party Websites may or may not be accurate and up-to-date.  Any questions about content you find on such Third-Party Websites should be directed to the owners of those Websites.

Digital Millennium Copyright Act Notice

If you believe that material on the Sites is being used in a manner that constitutes copyright infringement, please notify our Designated Agent (indicated below) in writing.  Pursuant to the Digital Millennium Copyright Act, we will, upon receiving effective written notification of such a claim, promptly remove or disable access to the allegedly infringing material.

To be effective, the notification must include the following information:

1. A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are claimed to be infringed on the Sites, then provide a representative list of such works.

2. Identification of the material on the Sites that you claim infringes on the copyrighted work(s) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to enable us to locate the material.

3. Your mailing and e-mail addresses and your telephone and fax numbers, so that we can contact you.

4. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner’s agent, or the law.

5. A statement by you that the information in the notification is accurate, and that, under penalty of perjury, you either are the copyright owner or are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

6. A physical or electronic signature of the copyright owner or of a person authorized to act on behalf of the copyright owner.

Anyone who knowingly misrepresents that material is infringing is liable for any damages incurred as of result of our relying on such misrepresentation in removing or blocking the material.

YOU AGREE TO INDEMNIFY, DEFEND, RELEASE AND HOLD PCA, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND ASSIGNS HARMLESS FROM ANY AND ALL SUITS, CLAIMS, EXPENSES (INCLUDING REASONABLE ATTORNEYS FEES), INCLUDING CLAIMS ALLEGED TO ARISE OUT OF PCA’S OWN CONDUCT, NEGLIGENT OR OTHERWISE, OR ARISING FROM OR RELATING TO YOUR USE OF THE THIRD-PARTY WEBSITES AND THIRD-PARTY CONTENT, INCLUDING ALL DAMAGES UNDER ANY THEORY OF LIABILITY, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR OTHER DAMAGES, REGARDLESS OF WHETHER OR NOT PCA HAD OR SHOULD HAVE HAD ANY NOTICE OF YOUR CLAIMS.

PRIVACY POLICY

Philadelphia Corporation for Aging (PCA) respects the privacy of visitors to our websites and strives to maintain the privacy and security of our visitors’ personal information.  This page states PCA’s Privacy Policy for the PCA websites, http://www.pcacares.org, http://www.keepseniorswarm.org, http://www.stopseniorscams.org, http://www.phillypetsandseniors.org, http://www.pcacareers.org, http://www.genphilly.org, and all other websites and communication channels of PCA with authorized links to this policy (collectively, the “Sites”).  By using the Sites you agree to the terms of this Privacy Policy.  If you do not accept this Privacy Policy, you should cease using the Sites.  We encourage you to read this Privacy Policy in full to learn how we treat your personal information while visiting our website and we encourage you to check back regularly for any updates. 

PCA’s goal is to provide users of the Sites with a safe and secure experience.  The only personally identifiable information collected here by PCA is information you voluntarily provide during your visit to the Sites.  If you choose to submit personally identifiable information regarding any content contained on our Sites, we may distribute this information, only as necessary, for purposes related to our services.  If you do not want PCA to have this information or to use it as set forth herein, please do not provide any personal information on the Sites.

The Sites collect certain non-personally identifiable data from visitors’ browsers, in an ongoing effort to make the Sites more useful to visitors.  Such data may include your Internet Protocol address, the name of your Internet Service Provider, your browser language, your browser type, the name of your computer’s operation system, and the site (if any) from which you were referred or linked to the Sites.

PCA will not disclose your personal information to third parties unless: (i) you consent to the disclosure; (ii) PCA is legally required or permitted to do so; or (iii) PCA believes in good faith that disclosure is necessary to comply with legal requirement or legal process, to prevent a crime, or to protect the personal safety of users or the public. 

Your use of the Internet and our Sites, including your transmission of any information to us, is at your own risk.  PCA takes reasonable physical, technical and administrative precautions to secure against unauthorized access and use of information sent to PCA.

The Sites contain advertisements and links to third-party sites (Third-Party Websites) over which PCA has no control.  PCA is not responsible for the privacy policies of the Third-Party Websites to which you link from the Sites.  PCA encourages you to review the privacy policies of those Third-Party Websites so that you understand if/how they collect and/or use information from you or your computer. 

PCA will modify this policy from time to time as may be required by changes in its processes and services.  Such modifications will be effective upon posting on this website.
